Strict Liability means that there is no need to provide proof of fault. That means if a dog bites a person, then there is no court fight over responsibility. The question to ask is simple:
Legal proceedings can be complex, and having professional legal advice is very beneficial. Here are some of the steps your lawyer will take on your behalf to help win your case:
Get medical treatment and make sure to keep all relevant documents that you can use as evidence.
Determine who the owner of the dog is. If you’re unsure, you can try to gather information from witnesses or consult public records.
Get familiar with California’s dog bite laws. Dog owners are generally held strictly liable for injuries caused by their dogs in public places or when the victim is lawfully on private property. Be sure to be aware of any specific local or county regulations that may apply
Your attorney will inform the dog owner about the incident and your intention to seek compensation for your injuries. It’s best to do this in writing and keep a copy of the notification for your records.
Prepare and submit a claim with the dog owner’s homeowner’s insurance company (if applicable) or directly with the owner if they don’t have insurance. Make sure to include a demand letter outlining the incident, your injuries, medical expenses, and any other damages you’ve suffered
If there were any witnesses present at the time of your dog bite injury in Orange County, make sure to get their contact information.
If negotation or mediation doesn't lead to a resolution, your attorney must file a lawsuit for damages in superior court

Dog bite laws differ on a state-by-state basis. In California, the law states that a dog owner can be found strictly liable for injuries caused by his or her dog. In other words, if you are bitten by a dog while on public property, or lawfully on private property, and injured from the attack, the dog owner is liable for your injuries.
Although California law holds the dog owner liable, the vast majority of dog bite cases are settled with that individual’s homeowner’s or renter’s insurance policy. Knowing this information often provides many of my clients some sense of relief, especially those clients who have a personal relationship with the dog’s owner and are hesitant to sue that individual personally.
At RMD Law, we believe that reputation is everything. When clients trust us with their cases, we do everything in our power to help guide them. That means personal service and sharp advocacy. We care about the details of your case because that is how we can get you the best settlement.
